Thanks for your time...please help.
My I-140 Denied couple of months back and I Appealed (I-290B) this decission with all the evidences to prove my exp & employer's ability to pay.
On June 11, 2009 I got the email from USCIS saying my I140 was approved On June 11, 2009.
But, on June 10, 2009 (previous day) USCIS denied my I485 as well as my wife�s I485. Please let me know, how to reopen both of these�

To my knowledge, this can be expected when 140 gets denied.. But when you get your 140 approved by MTR or other, you can initiate a process to re-instate the 485 and other which were filed before. Talk to a good attorney and I'm sure you'll be OK.
Take it easy and you'll be OK. Dont panic.. I have read that its not unexpected..

Alright all,
Celebrating the good news here.
Question: Did anybody receive confirmation about their AOS applications being returned after filling in early July (Say on the 2nd or 3rd)? I know there have been rumors about a few returned applications but I haven't actually found anyone in such situation + my attorneys confirmed today that USCIS specifically instructed not to return/reject them.

I think this become a problem for USCIS. might be they have some political pressure "not to allot Visa" and I dont think they will reversed. That I say American dadagiri. Rules for others only not for them

Could someone please verify the filing addresses for a FEDEX delivery.

The only difference is if you work for the univ on a cap exempt H1b and than transfer to industry on a cap H1b then you would have to go through the lottery or masters quoto whatever applies...however there is a loophole in this and I have read somewhere that when you apply for a transfer for a cap exempt to cap subject USCIS have goofed up and let it go through

I and my family have to travel to India urgently due to medical urgency. Our only AP document was taken last year and this year the renewal is not yet done. We are using our EAD status and H1 is expired and no longer available.
Is there a way I can get an emergency appt and a AP travel document. if yes, what do I need to do to get that.
If this question has been answered earlier, can someone point to the right source.

Check with the lawyer first...I don't think you can apply for AP while you are outside U.S. I know for sure, Reentry permit will be denied if you apply from outside U.S. I am not sure if it's the same for AP. Incidentally, you use the same 131 form for both...
So check with a lawyer before you act based on the advice from the forum, even if it means shelling some money...That money will be well spent...

I have an appeal Pending with AAO for a denied I140 EB3 India 2004, If I withdraw my appeal and refile I140 I know I will loose pending I485 application. but will have ability to extend my h1 in november showing the refiled I140?
Recently went through the following info....don't know if it helps you or not....
USCIS Policy on Refiling of I-140 Petition Pending AAO Appeal
The AILA-USCIS Service Center Operations Office Liaison minute indicates that the USCIS will allow the employers to refile I-140 petition when the denial of I-140 has been appealed and pending before the AAO. However, such refiled I-140 petition will be held in abeyance pending the decision of the AAO for the appealed I-140 petition. It advises that in order to seek the adjudication of the refiled I-140 petition, the employer must withdraw the pending AAO appeal. Like I said earlier, you have 240 days before you go out of status. If you are receiving an RFE, it means your case is under review. Upon receiving your response to the RFE, the officer should be able to adjudicate case fairly soon. However, if you are nervous, I recommend file for an expedited review when sending your response. That said, I would hate to pay the extra $$$$ if I don't have to.

I think Canada is much better option . It's cheaper and convenient. I have heard many success stories of H1 stamping in Canada
I've an appointment in October at Munich, Germany consulate for H1B stamping. Because of time constraints I decided to get the stamping done when I'm out there for work. I've already obtained the german visa (though had to provide plenty of explanation !). This is my 9th yr extn (MS, EB2 - 140 approved)
- Can anyone share their experience at the Munich consulate?
- or, should I plan going to Canada and trying rather taking the risk in Germany?

I got RFE on my whole family’s pending I-485 applications
The REF description is “ There is a missing signature in page 4 of your application. The signature of the person who prepared your form I-485 is missing. Please have it signed by the preparer, Mr. ABC”.
I used software owned by company(Ex) to prepare these forms. And Mr. ABC is heads for immigration department in that company. I entered all the necessary info in that application and took print out for 485 form. Mr ABC details and company address printed in the 4th page of I-485 application(Part 5.Signature of person preparing form, if other than above.(sign below)) area.
Mr ABC did not put the signature there because he did not prepare the application and sent application to USCIS. My signature is there in applicant area(no problem).
We got RFE for missing preparer signature.
Now,
I contacted ex-company to get the signature on my I-485 application but he no longer working with them. Company immigration people are telling me that the signature in not required in that form.
I contacted Mr ABC for signature but I am not sure his signature is valid now on my I485 application.(because he is no longer working with them)
Finally I think the "prepared by signature" is not at all required because I entered all my information for my I-485.

Leave aside ranking, this MBA program is not accredited by AACSB (AACSB International-The Association to Advance Collegiate Schools of Business (http://www.aacsb.edu)), the institution which accredits Business Schools. I wonder what value you will get in the market for an MBA from this University.

Very shallow DOF is a factor of Macro photography. Use the smallest f-stop you can and focus on the nearest plane. Experimentation is pretty much a necessity with Macro work.
