I was in a similar situation, I took my wife's GC with me when I went to India and she travelled back on GC instead of AP, no issues at the Immigration's.

Not to discourage any one but , my understanding from this forum is nothing with respect to RETROGRESSION and THUS OF SKILLED PEOPLE LEAVING THE SHORES will be done in the Lame duck session.
I wish some one prove me wrong and let us know if there is any new news.

IV members should take the moral high ground refrain from making frivolous calls to USCIS, so that genuine issues get addressed quickly by USCIS.
You don't want to be holding up the lines over a LUD when someone is waiting for a USCIS customer rep over a denied I-485.

I know for a fact that you cannot count current employer exp for GC.
You can use experience with the same employer, but not in the same position as you note next.
If i start working for the same employer on 15-1031.00 Computer Software Engineers, Applications , is it more than 50% different in role so i can count my 3 years experience when applying my GC ??
Nobody could tell just by looking at the DOT job descriptions. Your actual job and duties are what is important, not any DOL codes or descriptions. if your duties in the 2 jobs are 50% different, you should be able to use the experience.

I worked for company A as a full time employee from May 21st,07 to July 11th,08 and then company B filled my H1B transfer on June06th,08 and I joined company B on June 17th, 08 as a full time employee.
So there is a overlap, I mean I worked for company A and Company B as a Full time employee from June 17th,08 - July 11th,08 and got full time salary from both of these companies.
1. So will it be a issue, if companyB or some other company sponsers me a Green card in future?
2. Can I use the experience letter issued by the CompanyA for Green Card purposes? If not then shall I mention to my attorney/Company who will sponser me Green card that I worked for companyA till June 16th,08 and there is no overlap.

Your case may have a new "Last Updated" date and you may receive an Email Notification of your case being updated, without the status of the case changing. This is due to internal USCIS processing being performed on your Case. This will be reflected in the "Last Updated" date, but may not result in a different status message
For all the folks who have done FP and have received their EADs, did anyone ofyou got any LUDS on your AP case since the receitp date. If so, please let us know how many LUDS and how often you go them.

I am in 6th year of my H1B. It is expiring in Aug 2011.
Here are some details:
- My I-140 is approved with a priority date of Aug 2006 under EB2-India.
- I did not apply for I-485 so I do not have a EAD.
- My wife is also on H1B which expires in Aug 2012.
Here are my questions:
1) If I apply for H1B extension in July 2011 under regular processing and assuming it takes 4-5 months for USCIS to process the application, can I still continue to work? For how many days can I work if visa renewal is still in processing after the visa has expired.
2) If I get a denial of H1B extension do I become out of status from the date of denial or from the day H1B got expired?
3) If I get a denial of H1B extension can I immediately apply for H4 as a dependent to my wife's visa without any issues?
4) If I get a denial of H1B extension, what happens to my I-140? Is it automatically invalid?
5) If I do convert to H4 status and my priority date becomes current can I apply for I-485?

Today, My H1B transfer got denied and waiting for denial notice. Employer is planning to appeal on denial case. (I am assuming that "Denial could be becasue of client letter was not furnished)
My Layer: Employer->Company A-> Primary Vendor -> Client
My I-94 is valid Nov-09-2009 based on previous employer petition. Previous employer notified USCIS on H1B termination.
On this, What would be best option.
1. File a new H1B case thru current employer (while is waiting for appeal result, as a back up plan)?

3. Apply for H1B transfer thru primary vendor's sister concern?
