    I work with a consulting company on client side. The client is planning a shutdown for 2 days a month - 2nd and 4th friday.

    Do you guys think its gonna imapct 485 application. I am asking this question cause the labor was approved for 40/hrs per week and the salary slip shows the number of hrs worked per month which will be lesser than 160 (incase the month has 4 weeks).

    BTW, I am on EAD and 140 approved couple of years back.

    Along with other documents, include a copy of I485 Receipt Notice and EAD card.

    Did any body Tried that earlier, Like instead of sending the H1-B sent "I485 Receipt Notice and EAD card" for parents Visa ?

    There is a memo which says that you can get 1 year H1 till u get the license.

    However I am not sure if RN positions quality for a h1-b. There was a 50,000 green cards nurses category a cpl of years back for nurses because nurses do not quality for h1. However they did not extend the category.

    Thanks for the reply. But I have not yet received the approval. I have just received the receipt of H1B transfer application, and I am worried if they would not approve H1B transfer application since middle name has a typo. Please reply.

    It is a good sign for sure.
    I don't know about F/P notice, but for sure it can not be RFE
    i believe pre-adjudication does not even show on the status.

    It is a good sign, you are still in the system!!
    (1) It is most likely 2nd F/P notice or an RFE. It could mean that your case is being pre-adjudicated.

    In my opinion,
    Once a person starts working on EAD, his H1 status becomes void. I have read in forum that people still switch from EAD to H1, but I am not entirely sure on that one.

    But here is what your friend need to do:

    Presently I am on H1B visa status, valid till March 2009. My PD is of June 2005 and I-140 was done in 2005 also, presently trapped in retrogression.

    I have a great offer from a big oil company. After my possible joining to them with H1B transfer, they are willing to start my labor also. In such a case, I want my new labor to be filed ASAP, as my son will be 21 years old in march 2008.

    In a case I join this new company in middle of August, when do you think my labor could be filed....I heard there is some two months advertising involved before filing in PERM.

    You do need an H1 amendment. Had you applied for an LCA prior to starting your work in the new location, an amendend H1 would not have been required. But since you have already started working, you will need a new LCA and a new H1

    I guess EAD is personal property not employer property. I had filled my I-485, EAD and AP and my employer does not even know it. On top of it i had completed 180 days and moving to another job.

    Are you in H1B or EAD. If in EAD you have to renew it yourself the employer has nothing on your EAD.

    Hi,

    I changed employer in 2010 so my wife got new H4 valid until 03/2013 ( I-94 valid until 03/2013). She traveled to India last year and while returning she did not show her new H4 approval to immigration office so got I-94 until 08/2011 (old H4 was stamped until 08/2011).
    My question is does she need to file I-539 for I-94 extension? If yes, process is similar like any other(B1, B2) extension? I appreciate any kind of help.

    You might want to try CBP deferred inspection. For further details, go through the link below:

    U.S. Customs and Border Protection - Contacts (http://www.cbp.gov/xp/cgov/toolbox/contacts/deferred_inspection/)

    Talk to any CBP site at nearby International Airport, and tell them that "while entering I've submitted all the documents, but the I-94 was given based on the old petition".
    If one site denies, then try another site. Otherwise, you need to submit the application to USCIS to extend the I-94.

If one is abroad, the new company must file a new H1B petition. There is no pay stub problem in connection with the petition for a person living abroad, since there is no possibility of an extension of H1B status when the individual is not in the United States. (Lack of proper pay records may be an issue at the consulate in connection with an H1B visa application for one who was in the U.S. as an H1B employee, but was not being paid the required prevailing wage.) The H1B employee would need a new visa, if the earlier H1B visa stamp had expired.

    Got it... Just dont mention anything about H1 for sometime.. if something comes from company/HR tell them you want it done in premium since you (or your wife) might have to visit India soon. If they dont sound keen on doing it in premium, you can offer to pay the premium fee. Most employers dont object.

    Just my 2 cents.
