Why Bill Gates cares about immigration
Foreign workers have a stake in fight to change laws.
Activists on both sides of the immigration debate tend to focus on the millions of illegal immigrants whose fate rests on whether Congress passed a law.
But foreigners here legally also have a stake in this fight.
The U.S. issues temporary worker visas, called H-1B after their official classification, to thousands of non-residents each year. Often, they hold college degrees and have technical skills.
Microsoft and other technology companies hire many workers this way. They often have to prove they can't hire skilled U.S. citizens to fill those jobs first.
Bill Gates wrote in the Washington Post several years back that there is an employment gap that H-1B visas help fill:
This issue has reached a crisis point. Computer science employment is growing by nearly 100,000 jobs annually. But at the same time studies show that there is a dramatic decline in the number of students graduating with computer science degrees.
The United States provides 65,000 temporary H-1B visas each year to make up this shortfall -- not nearly enough to fill open technical positions.
H-1B workers, who have united under grassroots groups like Immigration Voice , want more than just an increase in visas. They want the government to streamline the rules.
Currently, the workers have to apply for green cards through their employers, often a lengthy and cumbersome process. They can't switch jobs easily and sometimes have to reapply for a visa even if they move jobs within the same company. They have to leave the country every few years before they can reapply for a visa.
The workers can also apply for a spouse to come to the U.S., but their partners are not allowed to work under the H-4 status granted to them. The activists argue that those individuals represent a skilled base of workers who could contribute to the U.S. economy and help pay for household expenses.
Powerful corporations back the H-1 B workers in their demands, since it would make it easier for them to hire skilled workers. But groups like Numbers USA argue that those companies shouldn't hire non-residents at a time when many Americans are jobless.

Any body has a soft LUD on approved EAD while I 485 pending.
Mine is 485 pending and my AP had (soft) LUD dated mid of Feb 2011.

no it doesnt....check on ..there are so many people getting consecutive luds...but then they dont get approvals. in the end it means that its a new lud. someone accessed your case and the lud was either because some accessed it or it was a system generated lud.
i hope that eb2-june03-dude gets his green soon...but the lud doesnt mean anything

- My friend has not been paid by his current employer. So no pay-stubs what so ever
That can be an issue in H1 transfer because he may be asked to prove that he has maintained valid status ( as there is no such things as bench on H1). This is a only a potential issue, not a showstopper as I know of transfers done without paystub.
- He had signed a contract for 2 years and some ridiculous amount of money towards damages in case he leaves
This is merely a threatening exercise by the employer to keep him from leaving. It does not have any legal bearings. I have done it myself in past.
What are his options now? What if the employer sends H1B cancellation before he gets to file a new petition through the new company? Can anyone please help?
The moment your H1 application is received by USCIS, you are safe. Even otherwise, USCIS generally takes a while to revoke the H1 after recieivng the application.
But if USCIS revokes H1 before the transfer request is recieved, then you are out of status and your new application will be denied.
But let me ask you one thing, if your friend is not being paid, why in this world he needs to even tell his employer about his plans to switch. Ask him to act smart.

I was initially issued pp for 5 years in India. Last year in '08 when it was expiring, i sent application for renewal of passport (NY Consulate) based on my EAD. However, instead of renewing it for another 5 years they renewed it for 1 year only. When I called the office, they said that they receive tons of pp's lon EAD which can be renewed for a year only.
Did anybody face this same problem? Can I apply for new passport based on I-485 receipt and would they issue passport for another 5 or 10 years?

In this economy you need to generate good revenue - this is a good revenue for Indian missions'.
BTW, As far as I heard from Indian Consular Officer in Chicago - Indian Mission has a right to issue a 1 year passport, if (1) Your previous passport had < 10 yr validity or (2) you are on a temporary visa (like visiting or tourist) trying to renew it in overseas or (3) you have not stayed outside India continuously for 3 years.

My friends mom had a issues, She was here 6 months and came back after 6 months . POE officer took her for inspection and called my friend and asked lot of question , gave the warning saying 'Visiting visa is for just visting not to stay in US'....

You can still get a 1 year extension claiming that your PERM application is still pending. It all depends on the officer that the decision has not been made on PERM application.
